Gallard Thomas 1859

This is the last Will and Testament of me Thomas Gallard of Grafton Regis in the County of Northampton Farmer I will and direct that all my just debts and funeral and testamentary expenses shall be fully paid and satisfied I appoint my Brother William Gallard and my Bother in law Thomas Franklin Executors of this my Will I devise all Estates vested in me upon trust or by way of Mortgage unto the said William Gallard and Thomas Franklin and their heirs and assigns Upon and subject to the trusts and equity of redemption affecting the same respectively I give and bequeath unto my Wife Martha All the plate linen and furniture in the Dwelling house now occupied by me formerly belonging to her And in case of any question or difference with respect thereto I direct that the decision or determination of my Executors shall be absolutely binding upon my said Wife and all other parties interested under this my Will I give and bequeath unto my said Wife the sum of five hundred and forty pounds being the amount of monies which as her husband I have since my marriage received to be paid to her within twelve calendar months next after my decease with interest thereon at the rate of four pounds per centum per annum from the day of my decease until payment thereof I give and bequeath unto my said Brother William Gallard the sum of one hundred pounds arise from the sale conversion and getting in of my said trust Estates Upon trust thereout in the first place to pay or retain all the expenses incident to the execution of the trust and powers herein to pay or retain all the expenses funeral and testamentary expenses and in the next place to pay the pecuniary Legacies hereinbefore bequeathed and upon further trust to invest the ultimate surplus of the said trust monies upon such security real Government or personal as my said Trustees shall think proper with power to vary the same from time to time and to pay the annual income thereof unto my Wife Martha and her assigns during her natural life And immediately after her decease upon trust to divide the capital of the said trust premises unto and equally between my Brother the said William Gallard and Joseph Kingstone Gallard and my Sister Mary Hipkins and Sarah Hipkins to whom I give and bequeath the same accordingly I expressly declare that my transaction or dealing with respect to my said trust Estate or any part thereof bond fide entered into or made by my said Executors and trustees shall be binding upon all parties interested under this my Will withstanding the same may not be in strict accordance with their duty as such Executors and Trustees and withstanding that the same may have resulted in a loss to my said Estates or not have been so beneficial thereunto as a different course might have produced I declare that the receipts of my said Trustees and Executors for the time being shall effectually discharge the purchaser or other person paying money under this my Will or the trust thereof And that such Trustees and Executors may submit matters to arbitration and generally act as they may deem beneficial to my Estate I direct that on the death refusal or incapacity to act of any Trustee or Trustee the surviving or acting Trustee his executor or administrator may require to whom any requisite conveyance and assignment may be made and who may act in the same manner as if named in this my Will I further declare that my Trustees and Exeutors for the time being shall only be answerable for their respective wilful default and that they may reimburse themselves and theirbe trustees and be-executors all costs and expenses incurred in or in relation to the trusts of this my Will I hereby revoke all former Wills by me made In testimony whereof I have hereunto set my hand this sixteenth day of November one thousand eight hundred and fifty eight
